Translation of book of Penal Law to English-Part 18

Penal Law and Morality

-Is morality the subject and objective of Penal Law?

As we've seen so far, Penal Law is an external applicable 'rhythm that on its legal basis, is only interested in legal/legitimate behavior of citizens, and members of societies. On the contrary it does not care and should not care in the personal morality of each one, nor in one's personal pursues and goals, ideas, thoughts or political persuasions. Consequently, the mission of Penal Law is not morality, therefore the obligatory forced achievement of a minimum of morality under threat of punishment. And let's add here, and in view of what we've said in previous parts of this, Penal Law as branch of Law, cares only of legal consequences and results of acts that involve morality, upon being turned to penal acts, and acquire a legal substance. Thus content of any act, involving morality, at personal level, who has legal results on punishment, based on Laws of Positive Law, that draw their content from Constitution, and upon turn of these moral acts to acts involving Law, in terms thus of subjective substance of moral act to objective substance of legal act, all this range of factors involved in such acts, may fall into sphere of Law, and in this case of Penal Law, as Social Law, where as such, -thus Penal Law as Social Law-sets in advance the frame of acts, by defining terms and conditions, that could under some circumstances, and regarding acts, as personalized ones, be penalized, in view of violation of this frame of rules, of laws, that constitute social behavior of citizens, further then personal relationships, and interpersonal ones, belonging yo social sphere of Penal Law, and giving substance and content to moral acts, that undermine social values as they are set and admitted by basic principles of Constitution and drawn from them, then Penal Law in view of its scope that is balance of social relationships, as main part of Penal/Social Law, could per case penalize, after legalization first, on basis of legal frame that would justify quality and type of aforementioned acts..and all above procedure we described in the beginning of paragraph, should mainly regard, essential law.
